Welcome to KIMSTAR INFORMATION TECHNOLOGY SERVICES (“Company,” “we,” “our,” or “us”). These Terms and Conditions govern your use of our Fiber to the Home (FTTH) internet services. By subscribing to or using our services, you agree to be bound by these terms.

2. Services Provided
We provide broadband internet services via FTTH technology. Service availability, speed, and performance may vary depending on location, network conditions, and technical limitations.

3. Subscription and Account

• Customers must provide accurate and complete information during registration.
• You are responsible for maintaining the confidentiality of your account and service details.
• The service is intended for lawful use only.

4. Installation and Equipment

• Installation will be scheduled upon confirmation of subscription.
• Necessary equipment (e.g., modem/router, fiber cable) may be provided by the Company.
• Customers are responsible for safeguarding Company-issued equipment. Damaged or lost equipment may be subject to charges.

5. Fees and Payments

• Customers agree to pay all applicable service fees on or before the due date indicated in the billing statement.
• Billing is typically on a monthly basis unless otherwise agreed.
• A grace period of three (3) days is allowed after the due date.
• Failure to settle the account within three (3) days after the due date will result in automatic service disconnection or termination.
• Reconnection of service may be subject to payment of all outstanding balances and applicable reconnection fees.
• Installation and activation fees may apply where applicable.

6. Service Availability and Interruptions

• We strive to provide continuous service but do not guarantee uninterrupted or error-free connectivity.
• Service interruptions may occur due to maintenance, upgrades, outages, or factors beyond our control.
• Scheduled maintenance will be communicated when possible.

7. Acceptable Use Policy
Customers agree not to:

• Use the service for illegal activities
• Distribute malware, spam, or harmful content
• Attempt unauthorized access to networks or systems
• Engage in activities that may harm network performance or other users

Violation of this policy may result in suspension or termination of service.

8. Termination and Disconnection

• The Company reserves the right to suspend or terminate services for violations of these Terms.
• Customers may request termination subject to applicable notice periods and settlement of outstanding balances.

9. Limitation of Liability

• The Company shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the service.
• We are not responsible for losses due to service interruptions, data loss, or unauthorized access.

10. Privacy
Your use of our services is also governed by our Privacy Policy. By using our service, you agree to the collection and use of your information as outlined therein.

11. Changes to Terms
We may update these Terms and Conditions at any time. Continued use of the service after changes constitutes acceptance of the revised terms.

12. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Philippines.
